In a claim based on a stolen shipment of cigarettes, 1) the Carmack Amendment to the Interstate Commerce Act applies to a suit by a successor-shipper against a carrier, 2) the carrier could not avoid liability by relying on a prior bill of lading, to which it was not a party, and 3) whether the carrier was authorized to leave the shipment unattended was not a genuine issue of material fact.
