United States Third Circuit

In an action for enforcement of rights under the U.S. Housing Act of 1937, after the parties reached a settlement which was memorialized in a court order, and plaintiff later filed a motion for enforcement of that order, which was dismissed as moot when defendant came into compliance shortly therafter, plaintiff was a "prevailing party" entitled to attorneys fees under 42 U.S.C. section 1988.
