NEXTEL PARTNERS INC. v. KINGSTON TOWNSHIP, 00-2502

The federal Telecommunications Act of 1996 (TCA) implicitly precludes an action under 42 U.S.C. section 1983 by creating a comprehensive remedial scheme that furnishes private judicial remedies; additionally, because the plaintiff never filed with the defendant a request for approval of its proposed communications facility, dismissal of its TCA claims was proper.
