United States Third Circuit

In calculating an award of attorneys' fees, the district court must use the market rate at the time of the fee petition, not the time the services were rendered, and must look to the market instead of an individual attorney, so a graduated rate based on the actual historical rates charged by the prevailing party's counsel is improper.
