LU v. ASHCROFT, 00-3393

An immigrant's claim of ineffective assistance of counsel can constitute proper grounds for reopening an exclusion proceeding, but it must comply with the procedural requirements set forth in Matter of Lozada, 19 I. & N. Dec. 637 (BIA 1988).
