NATIONWIDE MUT. INS. CO. v. COSENZA, 00-4151

The "dual recovery" prohibition in an automobile insurance contract, stating that an insured cannot recover benefits under both the liability coverage and the underinsured motorist coverage, is invalid and unenforceable under Pennsylvania's Motor Vehicle Financial Responsibility Law, 75 Pa. CSA 1701 et seq.
