United States Third Circuit

Defendant is entitled to resentencing if the district court fails to observe the requirement of F.R.Crim.Pro. 32(c)(3)(C) that the court personally address the defendant before imposing sentence and determine whether he wishes to make a statement or present any information in mitigation of the sentence.
