OMNIPOINT COMMUNICATIONS ENTER, L.P. v. ZONING HEARING BD. OF EASTTOWN TOWNSHIP, 99-1932; 99-1990

Pennsylvania law requires courts to determine whether a law actually excludes lawful activity before finding the law to be unconstitutional, even though aesthetic reasons alone are not substantial evidence for purposes of the Telecommunications Act of 1996, 47 USC 332(c)(7)(B)(iii).
