Where defendant betrayed the trust of a non-profit group by using its funds for personal gain, he did not commit bank larceny in violation of 18 USC 2113(b) where he lawfully withdrew the funds pursuant to the terms of the account and made no material misrepresentations to the bank to induce the release of the monies.
