MARSHAK v. TREADWELL, 99-5614

Under the Lanham Act, 5 USC 1065, a claim for cancellation of a trademark based on fraudulent procurement and a defense to an otherwise incontestable mark on a similar ground may be asserted at any time. But appellate court lacked jurisdiction to hear plaintiff's appeal of district court order requiring an accounting of plaintiff's profits because an order that contemplates further determiniation of damages is not a final judgment.
