United States Third Circuit

SCULLY v. US WATS, INC., 99-1590, 99-1653

Wrongful termination will not justify an employer's denial of employee's right to exercise his stock option following wrongful termination, and when awarding damages for breach of contract, there is no discount from market value to account for the option shares' lack of marketability.
