When a criminal complaint has been pending for some months and is dismissed, and thereafter an indictment issues charging offenses not contained in the dismissed complaint but arising out of the same criminal transaction, the Speedy Trial Act, 18 USC 3161, et. seq., does not require dismissal of the indictment.
