United States Second Circuit
PHL Variable Ins. Co. v. Town of Oyster Bay, 18-0575
Affirmed. Trial court dismissed Plaintiff’s complaint for failure to state a claim on the grounds that the claimed agreement entered into with Defendant had not be approved by the Defendant’s governing board as required by New York Town Law, hence there was no valid and enforceable contract.
