United States Second Circuit
Gurung v. Barr , 16-3883
Granted petition. Vacated removal order. Remanded. Plaintiff challenged denial of application for asylum. The immigration Judge denied application stating that it was not credible finding that there were inconsistencies in Plaintiff’s testimony. The Appeals court held that two of the purported inconsistent statements were not inconsistent at all and the third inconsistency did not justify an adverse ruling.
