Whitehurst v. United Healthcare Workers East, 18-3548

Affirmed. Plaintiff, a union worker, filed suit against Defendant alleging disability based discrimination. Defendants removed case to federal district court. District court denied Plaintiff’s remand motion and then dismissed claims as untimely. Appeals court held that all of Plaintiff’s claims were preempted by the Labor Management Relations Act and therefore the denial of remand and dismissal of complaint was proper.
