Benzemann v Houslander & Assoc. PLLC, 18‐1162
Plaintiff filed a Fair Debt Collection Practices Act claim against defendants. The trial court granted summary judgment against plaintiff on the grounds that the claim was time barred. The Second Circuit affirmed the grant of summary judgment against plaintiff stating that an FDCPA violation occurs when an individual is injured by the alleged unlawful conduct. Notice is not required for the statute of limitations to begin to run.
