Natofsky v. City of New York, 17‐2757

Held that but‐for causation is required to succeed on an employment discrimination claim under Rehabilitation Act section 504. Because a hearing-impaired municipal employee failed to demonstrate but-for causation, the Second Circuit affirmed summary judgment against his disability discrimination claim. In dissent, one judge argued for a motivating-factor standard.
