Francis v. Kings Park Manor, Inc., 15-1823

Held that a landlord may be liable under the Fair Housing Act for failing to take prompt action to address a racially hostile housing environment created by one tenant targeting another, where the landlord knew of the discriminatory conduct and had the power to correct it. The 2-1 decision allowed a tenant to move forward with a claim against his landlord under the circumstances here, vacating a dismissal. The dissenting judge suggested that the majority had steered the FHA into "unchartered territory."
