Sierra Club v. Con-Strux, LLC, 18‐257
Reinstated the Sierra Club's lawsuit seeking a declaration that a company was engaged in industrial activity within the meaning of the Clean Water Act but did not have the requisite permit to do so. The company in question recycled construction debris and waste. Vacated a dismissal.
