Cooling Water Intake Structure Coalition v. EPA, 14‐4645
Denied petitions for review filed by several environmental conservation groups and industry associations challenging portions of an Environmental Protection Agency final rule establishing requirements for cooling water intake structures at existing facilities. In an amended opinion, the Second Circuit held that the rule and a related biological opinion were based on reasonable interpretations of the applicable statutes and sufficiently supported by the factual record.
