United States Second Circuit
US v. Hoskins, 17‐70
Held that a defendant who had pleaded guilty to drug-trafficking charges could not challenge his sentence through a 28 U.S.C. section 2255 motion, even though a predicate conviction that had factored into the Sentencing Guidelines analysis was subsequently vacated. Remanded for the district court to reinstate the original sentence, in this appeal filed by the government from the lowering of the sentence.
