United States Second Circuit

US v. Lloyd, 16-3169

Affirmed a conviction on drug-trafficking and related firearms charges. The defendant, who pleaded guilty and received a 25-year prison sentence, contended that the trial court's plea colloquy failed to inform him of the nature of the firearms charge. On appeal, the Second Circuit agreed that the trial court had erred in failing to ensure that the defendant understood the nature of the charge but nonetheless rejected the challenge because the record did not establish that but for this error he would not have pleaded guilty. The panel also was unconvinced by the defendant's other arguments for vacatur of his conviction.
