Corren v. Condos, 17‐1343

Affirmed the dismissal of a lawsuit alleging that Vermont's campaign finance law violates the First Amendment. The Vermont Progressive Party and several former and prospective candidates for lieutenant governor argued that the statute violates the First Amendment by imposing restrictions on candidates who choose to receive public campaign finance grants, such as a prohibition on accepting private contributions. Unpersuaded, the Second Circuit held that the restrictions do not violate First Amendment rights because candidates may freely choose either to accept public campaign funds with the accompanying limitations or to engage in unlimited private fundraising.
