US v. Green, 16‐3044

Vacated a restitution order in a case where a woman stole veterans benefit payments that the government had mistakenly continued to send to her deceased mother. The defendant, who pleaded guilty to theft of government property, argued that restitution should be limited to monies stolen within the statute of limitations. The Second Circuit agreed with her, and therefore vacated in part the district court's restitution order.
