Vangorden v. Second Round, Limited Partnership , 17‐2186
Vacated dismissal of a consumer's claims that a debt collector violated the Fair Debt Collection Practices Act. The consumer alleged that the debt collector sent her a letter representing that she still owed money on a debt she had settled five years earlier, and requesting payment of that debt. Concluding that she plausibly alleged a violation of the statute, the Second Circuit held that the district court should not have dismissed her complaint for failure to state a claim.
