Zuniga-Perez v. Sessions, 17‐996

Held that two undocumented immigrants were entitled to a hearing on their motions to suppress evidence that was obtained during a search of their home. The Mexican citizens were arrested for immigration violations during a nighttime search of their residence by law enforcement officers purportedly looking for a criminal suspect. The two men contended that the search was unlawful and sought a hearing to suppress the evidence. The Second Circuit held that the denial of a suppression hearing was improper, and reversed and remanded the matter to the Board of Immigration Appeals.
