United States Second Circuit
US v. Lambus, 16-4296
Reversed the district court's pretrial rulings suppressing wiretap evidence and GPS tracking device data. In reversing, the Second Circuit agreed with the government's argument that the suppression rulings were improper because the mistakes in the application for a court-ordered wiretap were inadvertent and because it was permissible to use location data generated by a GPS tracking device attached to the defendant's ankle by his parole officers.
