Massey v. US, 17‐1676
Affirmed the denial of a habeas motion on procedural grounds in a case where a man was convicted of possessing a firearm as a felon. The petitioner sought to challenge the trial court's decision to enhance his sentence under the Armed Career Criminal Act. In affirming the denial, the Second Circuit held that the petitioner was not entitled to file a new habeas motion as his claim did not in fact rely on the rule set forth in Johnson v. US (Johnson II), 135 S. Ct. 2551 (2015).
