ACLU v. DOJ, 17-157
Vacated and remanded the district court's partial grant of summary judgment motions filed by both the plaintiff and defendant (government) in a Freedom of Information Act (FOIA) suit seeking lethal drone strike documentation that plaintiff initiated in 2011. In this latest appeal by the government the issue was whether the wording of the district court's order needed to keep a certain fact secret. The Second Circuit held that no decision need have been made by the district court regarding the certain fact.
