Villanueva v. United States of America, 16-2528

Remand for sentencing. Plaintiff was indicted for possession of a firearm by a convicted felon. Plaintiff had prior convictions for narcotics and first-degree assault which the district court concluded qualified plaintiff for sentencing under the Armed Career Criminal Act of 1984 (ACCA). At issue for the appeal was whether or not the first-degree assault under Connecticut General. Statute sections 53a-59(a)(1) qualifies as a violent felony for purposes of the ACCA. The 2nd Circuit held that it did and the matter was remanded for sentencing.
