US v. Sawyer, 15-2276

Vacated and Remanded. This is an appeal from the imposition of a 300-month criminal sentence for producing child pornography and receiving child pornography. The appeals court vacated the sentence and remanded the case for re-sentencing. This was the second time the case was remanded for sentencing and the appellate court believed it should be assigned to a different judge for re-sentencing. The appellate court stated that the district court did not give sufficient weight to the effect of the severe sexual abuse defendant suffered throughout his childhood and placed too much emphasis on defendant’s danger to the community.
