United States Second Circuit
US v. Litvak, 17-1464
Vacating the judgment of conviction of a man for securities fraud relating to alleged misstatements involving residential mortgage backed securities because, although they could be found by a jury to be material, the district court erred in admitting evidence that the counterparty representative in the sole transaction underlying the count of conviction mistakenly believed that the appellant was his agent.
