Duplan v. The City of New York, 17-1359
Affirming the dismissal of Title VII claims brought against the city of New York in a discrimination complaint brought by a former employee because he failed to fulfill the statute's exhaustion requirement, but vacating the dismissal of retaliation claims that were properly exhausted in the case of a gay black Haitian man whose supervisor allegedly made derogatory comments about black people, gay people, and Haitians, and allegedly gave preferential treatment to white women.
