Affirming a district court judgment dismissing a dormant commerce clause claim of a plaintiff challenging the authority of New York to allocate surplus highway toll revenues to the New York canal system because the unmistakably clear intent of Congress was to grant the Thruway Authority authorization to allocate highway tolls to support the canals and the district court had the discretion to reach the question of congressional authorization.
