Granting a petition for review of a Bureau of Immigration Appeals dismissal of the appeal of an Immigration Judge decision ordering removal and denying deferred removal under the Convention Against Torture in the case of a Dominican man with controlled substance convictions, determining that the agency committed a legal error in assessing the applicant's claim to CAT relief, but did not err in determining that he was removable by virtue of his federal drug trafficking conviction.
