United States Second Circuit
US v. Haak, 16-3876
Reversing and remanding a district court suppression order arising from the case of a man indicted for one count of possession with intent to distribute and distributing the controlled substance of fentanyl resulting in death because the district court conclusion that statements were coerced in violation of the Fifth Amendment when a detective made a false promise of immunity in return for cooperation was incorrect because the review of the facts did not reveal coercion and the detective never actually promised immunity.
