US v. Dupree, 15-1444

Affirming the district court's judgment convicting three brothers of committing and conspiring to commit the drug related murder of a Staten Island man and for conspiring to distribute cocaine base because the failure of the superseding indictment to allege the drug conspiracy involving at least 280 grams of cocaine base was not a plain error, the admission of challenged evidence was not an abuse of discretion, and there was sufficient record evidence to support the conviction.
