United States Second Circuit

US v. Huertas, 15-4014

Affirming the denial of defendant's motion to suppress a firearm that resulted in a plea of guilty to being a felon in possession of a weapon because a police officer responding to an alert of a man lurking with a gun in the area, shining a spotlight, and asking questions to which the defendant responded and which subsequently led to the discovery of his bag and a firearm did not amount to a submission to police authority or a seizure.
