United States Second Circuit
US v. Schaffer, 15‐2516
Conviction of coercing and enticing a minor to engage in illegal sexual activity in violation of 18 U.S.C. section 2422(b), is affirmed where: 1) the District Court did not err in denying defendant's motion to suppress, because defendant was not in custody at the time he made his incriminating statements; and 2) Federal Rule of Evidence 413 does not violate the Due Process Clause, and District Court did not err by permitting the government to introduce at trial portions of the four videos.
