Convictions of mail fraud and wire fraud and associated restitution order, arising out of a criminal retail scheme, are: 1) affirmed as to convictions where the district court has the 'right to control' jury instructions and there was sufficient evidence to support the challenged portions of the jury verdict; but 2) vacated as to the restitution order.
