Linares-Urrutia v. Sessions, 14-4419

In a petition for review of a decision by the Board of Immigration Appeals (BIA) dismissing petitioner's appeal from the denial of applications for asylum, withholding of removal, and relief under the Convention Against Torture, the petition is granted in part and remanded to determine whether petitioner's asylum claim was timely, where there is a question as to whether petitioner's four hour detainment in Canada before being returned to the U.S. counts as his 'last arrival' into the U.S. for purposes of 8 C.F.R. section 208.4(a)(2)(ii).
