United States Second Circuit

Sanford v. US, 16-1840

In a criminal action challenging defendant's sentence, the district court's denial of the motion is affirmed where defendant's waiver of his right to collaterally challenge his sentence in his plea agreement is enforceable and bars his challenge to his sentence under Johnson v. United States, 135 S. Ct. 2551 (2015), which declared the residual clause of U.S.S.G. section 4B1.2(a)(2) unconstitutional.
