Mitchell v. The City of New York, 14-0767
In a suit alleging false arrest against New York City police officers, the District Court's grant of defendants' motion for summary judgment and dismissal of the suit are: 1) vacated where there is a genuine issue of material fact as to whether the New York City Police officers had probable cause to arrest plaintiffs for trespass; and 2) affirmed as to dismissal of the malicious prosecution, abuse of process, and municipal liability claims.
