FTC v. LeadClick Media, LLC, 15-1009

In consolidated appeals brought by the Federal Trade Commission and the State of Connecticut seeking to hold defendant liable for its role in the use of deceptive websites to market weight loss products, the District Court's summary judgment in favor of plaintiffs is: 1) affirmed in part with respect to the claims against defendant LeadClick where it is liable for deceptive practices under the Federal Trade Commission Act and the Connecticut Unfair Trade Practices Act and it is not entitled to immunity under Section 230 of the Communications Decency Act; but 2) reversed in part with respect to the claim against defendant CoreLogic, LeadClick's parent company, where it is not liable for the obligations of LeadClick.
