US v. Greenberg, 14-4208

Conviction of thirteen counts in the Superseding Indictment, including wire fraud, access device fraud, aggravated identity theft, and money laundering, is affirmed where: 1) relying on Arizona v. Youngblood, 488 U.S. 51 (1988), defendant failed to show bad faith, so that his motion was properly denied; and 2) the district court did not err in denying defendant's motion to dismiss the wire fraud counts because of a 'lack of convergence' between the parties injured and those deceived by defendant's scheme.
