United States Second Circuit

El-Nahal v. Yassky, 14-405

In a civil rights action, brought by a taxi driver challenging a Taxi and Limousine Commission mandate requiring all New York City taxicabs to install GPS tracking systems as an illegal, property-based search under United States v. Jones, 132 S. Ct. 945 (2012), the district court's grant of summary judgment to defendants is affirmed where the record contains no evidence that plaintiff had any property interest in a taxi at the time of the alleged trespass or physical intrusion.
