Pierotti v. Walsh, 15-1944

In a habeas corpus action, brought by petitioner contending that his trial attorney provided ineffective assistance of counsel by failing to request an accommodation for his hearing disability, the district court's denial of the petition is vacated and remanded. The Court held that this case falls within a limited category of exceptional cases where the exorbitant application of a generally sound rule renders a state ground inadequate to stop consideration of a federal question under Lee v. Kemna, 534 U.S. 362, 376 (2002).
