United States Second Circuit

Kovaco v. Rockbestos-Suprenant Cable Corp., 15-2037

In an action brought by a maintenance worker against his former employer, alleging that he was terminated in violation of the Americans with Disabilities Act (ADA), the Civil Rights Act of 1964, the Age Discrimination in Employment Act, and Connecticut law, the district court's grant of partial summary judgment to defendant is affirmed where: 1) plaintiff failed to proffer a sufficient explanation for why his statement to the Social Security Administration, in a Social Security Disability Insurance application, that he was 'unable to work' should not judicially estop his discriminatory discharge claims; and 2) plaintiff abandoned his hostile-work-environment claims when he failed to address them while contesting defendant's motion for summary judgment.
