United States Second Circuit

Georges v. United Nations, 15-455

In a putative class action, seeking to hold defendant UN officials responsible for plaintiffs' injuries resulting from the UN's role in Haiti's cholera epidemic, the district court's dismissal for lack of subject matter jurisdiction is affirmed where the UN's obligation to make provision for the settlement of disputes involving immune officials under section 29 of the Convention on Privileges and Immunities of the United Nations (CPIUN), 21 U.S.T. 1418, is not a condition precedent to its immunity under section 2 of the CPIUN.
