United States Second Circuit

Doe v. US, 15-1967

In a case involving a former criminal defendant's attempt to expunge her sentence and conviction of health care fraud, the District Court order granting her motion to expunge in light of US v. Schnitzer, 567 F.2d 536 (2d Cir. 1977) is vacated where Schnitzer applies only to arrest records, and thus the District Court lacked jurisdiction to consider defendant's motion.
